The Seller invites you to carefully read these General Terms and Conditions of Sale before proceeding with any purchase through the Site.
- 1. Subject and Scope of Application
1.1 These General Terms and Conditions of Sale govern the distance sale of products on the website www.shoplykraft.com (“Site”).
By placing an Order on our website, the Customer declares that they have read, understood, and accepted these Terms and Conditions without reservation.
1.2 The purchase of Products through the Site may occur with or without registration and is allowed for both Customers who qualify as consumers and users who do not. A “consumer” means natural persons who, in relation to the purchase of products via the Site, act for purposes unrelated to any entrepreneurial, commercial, professional, or artisanal activity they may carry out.
The Site is reserved for retail sales, and therefore it is prohibited for entities intending to purchase Products for resale purposes to make purchases on the Site.
1.3 Access to the Site and purchase of Products through the Site are allowed to all Customers regardless of their nationality, residence, or place of establishment, provided, if natural persons, that they have the legal capacity to enter into binding agreements in compliance with applicable law (“Customer” or “User”). Delivery of Products purchased through the Site can be made only and exclusively within Italy.
1.4 The Customer declares that the data provided during registration and/or purchase are accurate and truthful. It is forbidden for the Customer to enter false, invented, or fictitious data during registration and/or purchase.
Double registrations or entering third-party data are expressly prohibited.
The Customer shall hold www.shoplykraft.com harmless and indemnify it from any liability, charge, or cost directly or indirectly connected to or resulting from:
- Entering incorrect or third-party data;
- Non-compliant use of the site www.shoplykraft.com by the Customer;
- Use of the Customer’s access credentials by third parties;
- Breaches by the Customer of these general conditions of sale.
In case of violation of these prohibitions or in the case of orders, from any source, that are anomalous regarding the quantity of products purchased or frequency of purchases or in violation of promotion access conditions, the Seller reserves the right to take all necessary actions to stop irregularities, including non-acceptance or cancellation of irregular orders or possible suspension of Site access and/or deletion of Site registration.
1.5 The Seller reserves the right to modify these General Terms and Conditions of Sale at any time; any new rules will take effect from the moment of their publication on the Site and will apply exclusively to sales made after their publication.

- 2. Conclusion of the Contract
2.1 Orders and subsequent Contracts are governed by these Terms and Conditions of Sale and any applicable law relevant to each Order and Contract.
The General Terms and Conditions of Sale are made available to the Customer via the Site section “Terms and Conditions”, reachable by the link in the Site footer. The Customer is allowed to save and reproduce them. They are also made available during the purchase process and must be accepted to proceed with the purchase.
For each Order, the version of the General Terms and Conditions of Sale published on the Site at the time of sending the Order by the Customer will apply.
Sales of Products on the Site constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree 6 September 2005, no. 206 (“Consumer Code”) and Legislative Decree 9 April 2003, no. 70, containing e-commerce regulations.
2.2 To conclude the Purchase Contract (“Contract”):
- a) The Customer must complete the order form on the Site, accept these General Terms and Conditions of Sale and submit the form to the Seller following the instructions displayed; the submitted order form constitutes a contractual offer and the Seller reserves the right to accept (or not) such offer.
- b) Before submitting the order form, the Customer agrees to carefully verify the correctness of the data entered. Any additional charges resulting from incorrect data may be charged to the Customer.
- c) Upon order submission, the Seller will charge the purchase price via the selected payment provider.
- d) Upon receipt of the Order, the Seller will send an order acknowledgment message (“Order Receipt”). This does not constitute acceptance of the order but only confirmation of receipt.
Both the Order Receipt and Order Confirmation include all essential order data, including product lists, prices, shipping costs, Customer details, billing/shipping addresses, right of withdrawal information, and link to Terms and Conditions.
2.3 Subject to the right of withdrawal in clause 10, the Customer may revoke the Order until the receipt of Order Confirmation by sending an email to Customer Service.
If the Customer revokes the Order in time, a confirmation email will be sent, the Order canceled, and the price refunded without undue delay.
2.4 Each Order can be viewed by the Customer on the Site in their personal area if registered, or via the link in “Contact Us”, “Online Purchases”, “Order/Shipment Information” sections for Guest users.
- 3. Products and Availability
3.1 Our Products are held by an external logistics service; their availability, packaging, and transport are outside our direct responsibility as we operate via dropshipping. Therefore, we are not liable for errors, delays, damages, or losses occurring during shipping.
3.1 a) All products offered for sale are described in detail on their respective Site pages.
Visual representations (photos, videos, etc.) are indicative and meant only to display the products without guaranteeing absence of minor discrepancies between images and actual products (e.g., color shades or packaging).
In case of discrepancy between product image and product description, the text description prevails.
3.2 Any purchase quantity limits (minimum or maximum) are indicated on product pages.
3.3 Product availability information is provided on each product’s info page.
Product availability is continuously updated, but multiple users may simultaneously purchase the same product, causing temporary unavailability and the need to wait for restocking.
3.4 If a product becomes unavailable, the Seller will promptly notify the Customer via email, acknowledging any refund requests and reserving the Customer’s right to compensation.
3.5 For orders with multiple products, if unavailability concerns only some products, clause 3 applies only to those products. Partial cancellations may occur, with possible non-full refund of delivery fees.
3.6 Registered Customers may request to be notified when a product becomes available again by activating the “Notify Me” function on the product page. This does not obligate purchase or constitute a reservation/order.
- 4. Product Reservations
For some products, the Seller offers the option to purchase special editions or colors not immediately available, ordered on behalf of the Customer by selecting the dedicated button on the product page.
These purchases are subject to these Terms and Conditions, with shipping times possibly exceeding 30 days as indicated on the product page. By ordering, the Customer expressly accepts such extended shipping times, overriding clause 9.
- 5. Order Cancellation by shoplykraft.com
The Customer is informed that in the following cases the Seller may cancel the Order. Applicable Customer rights under law remain unaffected.
- Product unavailability
Clause 3 applies in case of product unavailability.
- Pricing errors
If a product is mistakenly priced lower than actual, shoplykraft.com will contact the Customer to verify if they wish to buy at correct price. Otherwise, the order cannot be confirmed and any charges will be refunded.
- Promotion abuse and other violations
shoplykraft.com reserves the right to cancel Orders or Contracts if the Customer abuses promotions or violates clause 14, notifying via email. Any charged amount will be promptly refunded.
The Seller may also cancel Orders or Contracts on notice of fraudulent transactions from banking institutions.
- Force majeure
Force majeure includes strikes (internal or external), transport or supply blockages, governmental or legal restrictions, IT failures, telecommunication outages including internet.
Orders will be suspended upon notification to the Customer. If force majeure persists for 3 months, the Order is automatically canceled unless otherwise agreed.
- 6. Prices and Billing
6.1 Product prices on the Site include VAT where applicable and are clearly indicated. Invoices are issued upon Contract conclusion (Order Confirmation) and sent via email. Data cannot be changed after issuance; Customers must verify accuracy. Invoices are available in the Customer’s personal area under Orders.
6.2 Delivery costs are communicated during checkout and confirmed in Order Confirmation. Costs vary by delivery method, destination, order total, and clause 9.
6.3 Price changes become effective upon publication on the Site.
- 8. Payments
8.1 Payment methods for Products and shipping costs are indicated. Some methods are country-specific. Unavailable methods cannot be selected at checkout.
8.2 The Seller charges the purchase price upon order submission.
8.3 Credit card payments (Cartasi, Visa, Mastercard, American Express, Postepay) are made in favor of shoplykraft.com.
If payment is by credit card, the bank authorizes only the purchase amount. Upon order cancellation, the transaction is immediately canceled and funds released; delays are bank-dependent and shoplykraft.com is not liable for such delays or damages. The Seller may request additional documents to prove card ownership and may refuse contract conclusion if not provided. Personal payment information is securely transmitted to banks; shoplykraft.com is not liable for fraudulent use of credit cards.
8.4 Google Pay payments are made in favor of shoplykraft.com. The Customer selects Google Pay at checkout; upon order cancellation, refunds are processed via Google Pay.
8.5 Apple Pay payments are made in favor of shoplykraft.com. The Customer selects Apple Pay at checkout; upon cancellation, refunds are processed via Apple Pay.
8.6 Security and privacy: shoplykraft.com does not receive personal payment info, which is securely transmitted via Stripe. The Seller is not liable for fraudulent use by third parties.
8.7 Transaction cancellation: Upon order cancellation, the Seller requests immediate transaction cancellation and funds release; not liable for bank or Stripe refund delays.
8.8 Additional info: The Seller may request further documents to prove card ownership and may refuse contract conclusion if not provided.
- 9. Cash on Delivery Payment
Cash on delivery is available only for orders within Italy. Payment is made in cash to the courier upon delivery.
9.1 Cash on delivery order procedure:
- a) Phone Confirmation: After placing a cash on delivery order, the Customer must confirm purchase intention by phone. An external company contacts the Customer at the provided phone number. Failure to answer within 48 hours leads to automatic order cancellation.
- b) Data Verification: The Customer verifies order details including shipping address, total amount, and payment method during confirmation call.
- c) Additional costs: Cash on delivery may incur extra fees, disclosed during checkout and added to order total.
- d) Customer responsibility: The Customer must prepare exact cash amount; couriers may not provide change.
- e) Delays and cancellations: Refusal to accept delivery without notice may result in refusal of future cash on delivery orders.
- f) Order cancellation: Customers can cancel cash on delivery orders during confirmation by notifying Customer Service.
9.2 Delivery times are indicative and may vary; the Seller commits to delivery without undue delay and within 30 days. Delivery times vary by destination and conditions (weather, strikes).
9.3 Delivery costs, if any, are borne by the Customer and clearly stated at order time. Shipping may be free for certain thresholds or promotions.
9.4 Products are shipped to the address provided by the Customer. Upon dispatch, the Seller sends Order Confirmation with tracking number.
9.5 Deliveries occur only on working days and are completed when the product is made available at the address.
9.6 If delivery fails due to recipient absence, courier holds the package up to 10 days for collection. Customer receives email with instructions to reschedule or release package. If not collected in 7 days, products return to Seller and Contract is terminated.
9.7 At delivery, Customer must check quantity and packaging integrity. In case of damage or discrepancies, note “ACCEPTED WITH RESERVATION” on delivery receipt and notify Customer Service immediately.
9.8 Customer must report any damage or missing items promptly to Customer Service with order details.
9.9 Force majeure, transport unavailability, or unforeseeable events causing delays, delivery difficulty, or increased costs allow Seller to delay, split, cancel delivery or cancel Order (see clause 5).
- 10. Right of withdrawal and refund
10.1 This clause applies to Consumer Customers. Within 14 days from delivery, the Customer may withdraw without penalty or reason.
10.2 Delivery date from courier or email timestamp will prove withdrawal timeliness. Return via tracked shipping is recommended.
10.3 To exercise withdrawal, Customer can either:
- Send an email to assistance@shoplykraft.com
- Use the Site procedure: login, go to “Orders”, select order, click “Request return” and follow instructions, indicating “PRODUCT – Changed my mind” as reason. Guests can use the link in homepage footer under Contact Us – select “Return request”.
10.4 Upon receiving withdrawal notice and verifying terms, Seller will email Customer return instructions.
Return shipping costs are borne by Customer. Return shipment must be traceable and products returned within 30 days of withdrawal confirmation.
10.5 Seller will refund amounts paid including shipping (if applicable) within 30 days of withdrawal notification. Additional costs requested by Customer are not refunded.
10.6 Refunds are issued to the payment originator unless payment was COD, in which case Customer must provide IBAN for refund.
10.7 Customer is liable for value depreciation due to handling beyond what is necessary to establish product nature, characteristics, and functioning. Products must be returned intact with all accessories, manuals, original seals intact, and free from signs of use or dirt (e.g., stroller wheels must be in perfect condition, free of marks), preferably in original packaging.
Refund amounts may be proportionally reduced due to depreciation from improper handling.
10.8 Withdrawal does not apply to customized goods, medical devices, sealed goods not returnable for hygiene or health protection reasons if opened, and food products.
Customized Products cannot be returned or refunded. Personalization includes engraving, modifications, special design requests, or any alteration made on Customer request. Once ordered, such Products cannot be canceled or refunded unless defective or damaged not due to misuse.
For issues with customized Products, Customer must contact us within 14 days of receipt to discuss possible solutions.
10.9 For Products purchased at discounted prices, only the discounted price will be refunded, subject to other requirements.
10.10 If Products are returned without proper right of withdrawal, Seller may refuse the withdrawal, return the products to Customer, and charge shipping costs.
10.11 The right of withdrawal does not apply in the following cases:
- Supply of made-to-measure or clearly personalized goods;
- Supply of sealed goods not returnable for hygiene or health protection reasons if opened;
- Supply of goods likely to deteriorate or expire quickly;
- Supply of sealed audio or video goods if opened;
- Supply of newspapers, periodicals, or magazines;
- Orders not arriving due to Customer’s fault (e.g., incorrect shipping address);
- Orders delayed due to exceptional circumstances beyond Seller’s control (e.g., natural disasters).
- 11. Legal warranty
11.1 For Consumer Customers, all Products are covered by the legal warranty under articles 128-135 of Legislative Decree 206/2005 (Consumer Code): the Seller is liable for conformity defects existing at delivery and hidden defects appearing within two years. Customers can request warranty service via the online form, indicating the defect, photos, order confirmation, and receipt.
11.2 The Seller will instruct Customer on repair or replacement. The Seller will arrange free return pickup and repair or replacement within 30 days. Products must be complete and intact.
11.4 If repair/replacement is refused, Customer will be promptly informed and may collect the product within 30 days at own expense.
11.5 Hidden defects claims expire after 26 months from delivery.
11.6 The Seller is not liable for indirect or consequential damages such as profit loss, production limitations, administrative costs, or third-party claims.
11.7 For non-consumer Customers, Civil Code articles 1490 et seq. apply excluding damages.
11.8 Products may have a manufacturer’s warranty; Seller is not responsible. Manufacturer’s warranty does not replace legal warranty.
